September 2002 Adjudication workshop
The Chartered Institute
regularly holds events in London (now at our own centre at 12 Bloomsbury
Square). Recently, there was an event
addressing dispute resolution in general, organised by Winward Fearon lasting
from 2pm to 6pm on 26 September and a full day on 26 October comprising an
adjudication workshop in the morning and a mock enforcement of adjudication in
the afternoon.
The Winward Fearon
meeting was intensive, including a comprehensive examination of mediation,
adjudication, arbitration and litigation, and at £45 gave good value.
The adjudication
workshop on 26 October comprised an update on recently decided cases and group
discussion on 11 adjudication problems (which had been sent to delegates
beforehand and required a simple yes or no answer). Of the 26 delegates, there
was a clear majority in all but one of the 11 cases. The outstanding problem
involved the Referring Party introducing test reports with its Referral, which
had not been produced earlier and whether the adjudicator should admit the
report. The question concerns the most
recent Nuttall -v- Carter case, which is mentioned in the Legal Comment herein.
At £155 for the full day, including lunch, I thought it was reasonably good
value and certainly much cheaper than commercial courses of the same duration.
