Forthcoming Meetings

All members are welcome to attend the following technical meetings, which start at 6 for 6.30pm unless otherwise stated. They are organised for you by your local branch. Attendance is free to all grades of members and the atmosphere is informal. We especially welcome our newer members, who can meet and share experiences with other members of all grades.

Existing and aspiring Chartered Arbitrators and members of Panels are reminded that they are required to gain at least 60 CPD points in each three-year period. Our technical meetings each count as 1.5 CPD points. So whether you are looking to add to your CPD, are interested in the topics, or just want to do some networking, why not come along?

Tea and coffee will be available before each talk and dinner will be available at a cost of £15.00 per person, payable on the night, for those wishing to stay afterwards. Joint Meeting with CIOB PETER BARNES : JCT 2005

Peter Barnes is a Director of Alway Associates. He is a Chartered Arbitrator and Adjudicator, and is the author of the book titled 'The JCT '05 Standard Building Sub-Contract'. He is co-author of a further book on JCT 2005 Sub-Contracts due to be published early in 2008. The JCT suite is the most commonly used throughout the construction industry, and a major overhaul in 2005 included revisions and new options to existing contracts and the introduction of entirely new forms. Peter will provide an overview of the changing content of the JCT suite, and will highlight the significant alterations from the earlier forms.

PETER ASHFORD, Head of Commercial Dispute Resolution, Cripps Harries Hall LLP: INTERNATIONAL ARBITRATION

Peter Ashford is a partner and the head of commercial dispute resolution at Cripps Harries Hall LLP. Peter has been involved in representing parties in arbitration for over 20 years. Over the last 6 years he has become increasingly involved in international arbitration, and in the last 2 years this has increased to almost a full time role. Peter will consider what makes Arbitration "International", and the role of "Institutional" Arbitration. He will also review the key differences between international and domestic arbitration and managing the cultural expectations of the parties.

HIS HONOUR JUDGE ANTHONY THORNTON QC: JUDGE-LED MEDIATION AND OTHER TCC DEVELOPMENTS IN ADR SUPPORT

We are pleased to welcome HHJ Anthony Thornton QC to give the talk following our 2008 Annual General Meeting. Judge Thornton has been extensively involved in the Technology and Construction Court's Judge-led mediation initiative, and has offered to enlighten us on this and on how the TCC supports other forms of ADR. In particular, he hopes to cover:

  1. (i) The interface with arbitration in all court-based construction arbitration interventions, particularly appeals and substantial irregularity applications;
  2. (ii) The interface with adjudication in all enforcement applications. These have created a procedural framework for adjudications and have set minimum standards of fairness and tribunal behaviour;
  3. (iii) Mediation in (a) encouraging parties to court-based disputes to mediate and (b) setting up the successful pilot judge-led mediation scheme.
  4. (iv) In its judgments particularly in the procedural, costs and enforcement fields, in all areas of ADR;
  5. (v) Assisting mediation in identifying the limits of privilege and confidentiality;
  6. (vi) Assisting arbitrators in setting procedural and evidential safeguards in the judgments handed down in all areas of ADR;
  7. (vii) Assisting adjudicators in being able to identify what are and are not genuine or bona fide jurisdictional arguments.

MIKE OWEN, CIArb Director of Marketing, Membership and Training

Mike Owen joined the CIArb in June 2007 as Director of Marketing, Membership and Training. His remit includes elevating the profile of the CIArb in new sectors, promoting the benefits and services offered, enhancing communications and support to members and branches across the UK and internationally, and developing the education, professional training and e-learning support programmes.

Mike will provide us with an update on the Institute's latest developments and projects for 2008, including the CIArb Pathways education & training programme, together with open question/answer/discussion on where CIArb is/should be heading over the next few years.

Mike has been extensively involved in the re-launch of the CIArb’s updated and refined “Pathways to Fellowship” programme, which includes many exciting developments. The Pathways programme is intended to give a world-class framework of knowledge and skills standards, and an associated range of education and professional qualifications, for people working in the field of ADR. The route to Fellowship and Chartered status has been extensively revised, and a new route to Fellowship now exists for adjudicators. It is hoped that a Pathway from Member to Fellow for mediators will follow in the early part of 2008. As well as his general update, Mike will provide a valuable overview of how these changes will affect those wishing to join or progress through the CIArb.
