Forthcoming Meetings

All members are welcome to attend the following technical meetings, organised for you by your local branch. Attendance is free to all grades of members and the atmosphere is informal. We especially welcome our newer members, who can meet and share experiences with other members of all grades.

Existing and aspiring Chartered Arbitrators and members of Panels are reminded that they are required to gain at least 60 CPD points in each three-year period. Our technical meetings each count as 1.5 CPD points. So whether you are looking to add to your CPD, are interested in the topics, or just want to do some networking, why not come along?

We also provide an optional hot buffet supper for those who wish to stay and socialise after the meeting (or who are hungry). The charge for this is a very reasonable £15 per head.

PRESENTING A CASE - A lawyer's perspective

Chris Hough

This will be an essential talk for all those involved in presenting a case - whether it's a referral notice in adjudication or a statement of case in arbitration or litigation. Chris has extensive experience as tribunal and as advocate, as well as a background in construction. He will use this to explain the most effective way to advance your client's interests in a wide range of disputes.

Chris Hough is a well-known adjudicator. He is both a Chartered Engineer and a solicitor. He specialises almost exclusively in construction law. He works in the fields of adjudication, arbitration, litigation, mediation and other ADR proceedings both in the UK and internationally. He has accepted more than 80 appointments as adjudicator in disputes valued to over £1m and has given a similar number of decisions. He founded adjudication.co.uk in January 2000. Chris is a member of the ICE Conciliation and Adjudication Advisory Panel (CAAP) and Chairman of the TeCSA Adjudication Sub-Committee.

New JCT05 Contracts - the Main Changes

This is one of the earliest opportunities to catch up with the new JCT contracts, the first of which was launched in May. There are major changes to the extensions of time/liquidated damages clauses and to the dispute resolution provisions.

We are very fortunate that John Riches (East Anglia Branch) has agreed to give an introduction to the changes. He is especially well placed to do so, as he was a member of the Drafting Committee.

John Riches is an experienced Arbitrator, Adjudicator and Mediator and is well-known to the Branch - he gave us a talk recently on decisions ('Bad, Mad or Sad'?) in arbitration and adjudication. He was the adjudicator in Workplace Technologies v E Squared (TCC unreported), and his practice acted for Herschel in Herschel Engineering v Breen Properties. He is the author, with Chris Dancaster, of 'Construction Adjudication', recently revised and updated for its second edition.

Disputes in Employment -Avoidance, Settlement and Resolutions

Most of us are employees or in some cases employers and will unfortunately get involved in disputes at our workplace. Sylvia will give us an insight into some of the common problems that arise in the workplace and what approach can be taken to avoid them happening in the first place. She will also share with us how the parties can resolve the dispute if they are face with one.

Sylvia Cashman is the Industrial Relations Manager for BAA on the Terminal 5 project at Heathrow who employs about 6000 people. Prior to joining the Terminal 5 project Sylvia held a number of line management and senior HR roles in BAA, having led both HR Operational and Employee Relations Teams at Heathrow.

Adjudication under the ICE and NEC forms of contract - Joint meeting ICE/CIArb

The purpose of this evening is to bring members up-to-date with recent amendments to the ICE and NEC Standard Conditions of Contract. In May 2004 the Sponsoring Bodies of the ICE Standard Conditions published amendments to their dispute resolution clauses. In July 2005 the ICE also published the 3rd Edition of the NEC family of contracts, which included many changes from previous editions. Our speakers this evening will explain these important changes, and the philosophy behind them, and will be happy to conclude with questions from the floor.

Derek Ross will describe the amendments to the ICE dispute resolution clauses, which mark a radical change in the Sponsoring Bodies' thinking, including the abolition of the Engineer'??s Decision as the first essential step in the formal dispute resolution procedure under an ICE contract. There are also several other innovations that Derek will describe. He will also discuss the essential features of the traditional provisions that these new amendments are intended to replace, as both sets of provisions are likely to be met in practice during the present period of transition.

Peter Cousins will describe recent changes in the Adjudication provisions of the NEC form of contract and the thinking behind them. He will also outline other changes to the contract that may affect the Parties' entitlement to additional time and monies under this innovative form of contract.

Dr Derek Ross is a Chartered Civil Engineer and Fellow of the Institution of Engineers of Ireland with over 20 years experience of working with both contractors and consultants. He is currently Course Director of Adjudicator Training at the Chartered Institute of Arbitrators, and is a past Chairman of their South East Branch. He is also a past Council member of the Society of Construction Law, and for the past 12 years has practised full-time in the field of construction dispute resolution. He is a Chartered Arbitrator, Accredited Mediator and Adjudicator on a number of institutional panels, including ICE's."

Peter Cousins is a Chartered Civil Engineer with over 20 years experience of working for contractors in the UK construction industry. He has been a member of the NEC Panel of the ICE since 1999 and helped redraft the primary contract in the NEC family of contracts, the Engineering and Construction Contracts (ECC), including its revised adjudication provisions. He has also helped to redraft the Guidance Notes for this form of contract. Peter is a Chartered

Hands up Who Wants to be an Expert Witness - our experiences

Jim Breakell and Darrell Leek

There is more to being an expert witness than giving oral evidence in a tribunal or court. Jim and Darrell will give us an insight into some of the protocols and procedures that need to be followed and how they approach assignments and deduce conclusions. They will also share with us some good and bad experiences.

Jim and Darrell coordinate the Dispute Resolution Group at Mott MacDonald. Their own specialist technical areas are in materials and corrosion control. They have acted as expert witnesses on many cases covering a broad range of problems and industrial sectors both within the UK and overseas.
